It is up to the pool owners to maintain and keep the pool safety to the current standards. The data base renewal reminders are a service only offered to you by request of you, it is up to the pool owner to maintain a valid certificate where needed .

A swimming pool is defined as an above or belowground structure principally used for swimming that can hold water with a min. 300mm in hight, including some most models of portable pools and spas.
If your portable pool or spa can hold more than 300 millimetres in hight of water then the laws apply to you. The pool laws don’t apply to fishponds, however, if you have a swimming pool that is now being used for another purpose e.g. as a fishpond, it is still considered a pool and must have a compliant barrier.
All pools in Queensland must be registered with the QBCC. List your pool on the pool safety register. We are happy to register your pool with the QBCC at no cost to you.
Penalties for non-compliance
Local governments have the power to investigate compliance with pool safety standards and can issue fines.If you don’t comply with pool safety standards, local governments can issue on-the-spot fines of $883.05 for individuals and $2523 for companies. The maximum penalty a court can impose is $20,814.75.
eg: props to open a pool gate, over grown vegetation, tables and chairs to fence, etc.If you fail to register your pool, QBCC can issue penalties which includes an on-the-spot fine of $252.30 for individuals or $756.90 for companies. The court can impose a maximum penalty of up to $2523.

If you make any changes to your fencing your pool safety certificate becomes invalid and a new certificate MUST BE OBTAINED
When you sell your house a valid pool safety certificate must be issued. We advise to book an appointment with us when you put your property on the market.
For each lease you sign to rent out your property you must have a valid pool safety certificate. We advice you to supply the information booklet attached to our pool safety certificate to the new tenants, even if your property is included in a body cooperate.
If you manage an accommodation business with a pool, the Qld Government has made it necessary for your business to hold a current Pool Safety Certificate.
New pool safety laws came into effect from 1st December 2010 and shared pool certification is required by all Resorts, Hotels, Motels, Caravan Parks, Backpacker hostels, Aibnb's and other Business establishments that rent room accommodation and have swimming pools.
